Age discrimination in being hired

In Spain, candidates for being police agents have to be less than 35 years old. Is this a discrimination?

One of the candidates, who had been refused because of his age, claimed the hiring conditions were not respecting European directive 2000/78/EC of 2000 which prohibits any, direct or indirect, discrimination based on age.
