
Transport Refund posted about an important extension of the obligation for airlines to compensate, which results from the ECJ judgment of 17 February 2016 in the Air Baltic case.
In case of delay, any flight thus gives compensation rights to two beneficiaries :
- the passenger him(her)self (in the person of the employee): he(she) has a right to compensation according to EU regulation 261/2004, up to 600 euros.
- the employer, if he is a party to the flight booking contract, who has to be compensated for the damage caused by the delay experienced by his employee.
